AVENTUS RIDE TERMS AND CONDITIONS

1. AGREEMENT TO TERMS
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Aventus Ride LLC ("Aventus Ride," "we," "us," or "our") governing your use of our transportation services, website (www.aventusride.com), mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

2. SERVICES DESCRIPTION

2.1 Transportation Services
Aventus Ride provides the following transportation services:

Non-Emergency Medical Transportation (NEMT)
Airport Transportation
Black Car Service for private and corporate events
Other transportation services as described on our website or in our communications

2.2 Service EligibilityTo use our Services, you must:
Be at least 18 years of age or have the consent and supervision of a parent or legal guardianProvide accurate, complete, and current information when scheduling transportation
Comply with all applicable laws and regulationsMeet any additional requirements specified for particular services (e.g., insurance eligibility for medical transportation)

2.3 Service Availability
Our Services are available within the five boroughs of New York City (Manhattan, Brooklyn, Queens, Bronx, and Staten Island). Service hours and availability may vary based on location, service type, and demand. We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without prior notice.

3. BOOKING AND SCHEDULING
3.1 Booking MethodsYou may book our Services through:

Through your insurance provider (for eligible NEMT services)

3.2 Required Information
When booking, you must provide:
Full name and contact information
Pick-up and drop-off locations
Date and time of service
Type of service required
Any special accommodations needed
Insurance information (for NEMT services, if applicable)Any other information necessary to complete your booking

3.3 Confirmation and Changes
Upon successful booking, you will receive a confirmation via your preferred communication method. Any changes to your booking must be made at least 24 hours prior to your scheduled service time, subject to availability. Changes requested with less than 24 hours' notice may not be accommodated and may result in additional charges.

4. PAYMENT TERMS
4.1 Pricing
Our pricing varies based on the type of service, distance, time of day, and other factors. Current pricing information is available upon request. For NEMT services, pricing may be determined by your insurance coverage. We reserve the right to modify our pricing at any time without prior notice.

4.2 Payment Methods
We accept the following payment methods:

Major credit and debit cards
Electronic funds transfers
Insurance coverage (for eligible NEMT services)
Other payment methods as specified on our website or during booking

4.3 Insurance Billing (NEMT Services)For NEMT services covered by insurance:

You must provide accurate and complete insurance information
We will verify your eligibility with your insurance provider
You are responsible for any services not covered by your insurance
You authorize us to bill your insurance provider directly for covered services

4.4 Additional Charges
Additional charges may apply for:
Cancellations or changes made less than 24 hours before scheduled service
No-shows or failure to be ready at the scheduled time
Waiting time exceeding 15 minutes from the scheduled pick-up time
Additional stops not included in the original booking
Special accommodations or equipment
Cleaning fees for excessive mess or damage

5. CANCELLATION AND REFUND POLICY
5.1 Cancellation by User
Cancellations made more than 24 hours before your scheduled service will not incur a cancellation fee
Cancellations made less than 24 hours but more than 2 hours before your scheduled service may incur a cancellation fee of 50% of the total service cost
Cancellations made less than 2 hours before your scheduled service or no-shows may incur a cancellation fee of 100% of the total service cost

5.2 Cancellation by Aventus Ride
We reserve the right to cancel or reschedule your service due to:

Severe weather conditions
Vehicle mechanical issues
Driver unavailability
Other unforeseen circumstances beyond our control

In such cases, we will make reasonable efforts to notify you as soon as possible and either reschedule your service or provide a full refund, at our discretion.

5.3 Refunds
Refund requests must be submitted in writing to info@aventusride.com within 7 days of the scheduled service date. Approved refunds will be processed using the original payment method within 10 business days.

6. USER RESPONSIBILITIES AND CONDUCT
6.1 General Conduct
When using our Services, you agree to:

Be present at the designated pick-up location at the scheduled time
Treat our drivers and staff with respect and courtesy
Comply with all safety instructions provided by our drivers
Use seat belts and other safety equipment as required by law
Not engage in disruptive, threatening, or illegal behavior
Not possess or use illegal substances in our vehicles
Not smoke, vape, or consume alcoholic beverages in our vehicles without prior authorization
Not damage our vehicles or equipment

6.2 Special Needs and Accommodations
If you require special accommodations (e.g., wheelchair accessibility, medical equipment, service animals), you must notify us at the time of booking. We will make reasonable efforts to accommodate your needs, subject to availability.

6.3 Minors
Passengers under 18 years of age must be accompanied by an adult unless prior arrangements have been made and approved by Aventus Ride. Parents or guardians are responsible for providing appropriate child safety seats as required by law.

6.4 Personal Belongings
You are responsible for your personal belongings at all times. Aventus Ride is not responsible for any lost, stolen, or damaged items left in our vehicles. Any items found in our vehicles will be held for 30 days and can be claimed by contacting our office.

7. AVENTUS RIDE RESPONSIBILITIES
7.1 Service Quality
We strive to provide safe, reliable, and professional transportation services. Our drivers are properly licensed, insured, and trained to provide courteous and efficient service.

7.2 Vehicle Standards
Our vehicles are regularly maintained, cleaned, and inspected to ensure they meet safety and comfort standards. All vehicles comply with applicable regulations and licensing requirements.

7.3 Timeliness
We will make reasonable efforts to arrive at the scheduled pick-up time. However, factors beyond our control (e.g., traffic, weather, road conditions) may affect arrival times. We recommend being ready 15 minutes before your scheduled pick-up time.

8. LIMITATION OF LIABILITY
8.1 Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AVENTUS RIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.

8.3 Cap on Liability
IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICES EXCEED THE GREATER OF (I) THE AMOUNT PAID BY YOU TO AVENTUS RIDE FOR THE SERVICES GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTH PERIOD PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR (II) $100 USD.

8.4 Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for certain types of damages. Accordingly, some of the above limitations may not apply to you.

9. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Aventus Ride, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services, including, but not limited to, any use of the Services' content, services, and products other than as expressly authorized in these Terms.

10. INTELLECTUAL PROPERTY
10.1 Ownership
All content, features, and functionality of our website and mobile applications, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, and software, are the exclusive property of Aventus Ride, our licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

10.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use our website and mobile applications solely for the purpose of booking and managing your transportation services or learning about our Services, subject to these Terms.

10.3 Restrictions
You may not:
Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website or mobile applications
Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials from our website or mobile applicationsAccess or use our website or mobile applications for any commercial purposes other than booking our Services

11. PRIVACY
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and disclose information about you. By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

12. TERMINATION

12.1 Termination by Aventus Ride
We may terminate or suspend your access to our Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

12.2 Termination by User
You may terminate your use of our Services at any time by discontinuing use of our Services and canceling any scheduled transportation in accordance with our cancellation policy.

12.3 Survival
All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. CHANGES TO TERMS
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Services.

14. GOVERNING LAW AND DISPUTE RESOLUTION
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

14.2 Dispute Resolution
Any dispute arising out of or relating to these Terms or your use of the Services shall be resolved exclusively by the state and federal courts located in New York County, New York, and you consent to the personal jurisdiction of these courts.

14.3 Waiver of Class Actions
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, you waive any right to a jury trial.14.4 Limitation PeriodAny claim or cause of action arising out of or related to use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

15. MISCELLANEOUS

15.1 Entire Agreement
These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Aventus Ride concerning your use of the Services.

15.2 Waiver
No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

15.3 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect.

15.4 Assignment
You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent will be null and void. We may assign or transfer these Terms, at our sole discretion, without restriction.

15.5 Notices
Any notices or other communications provided by Aventus Ride under these Terms will be given by posting to the website or by email to the address you provide during booking.
